Scope

This warranty is a voluntary commercial guarantee given by ANNAPOM SOLUTIONS LLC, trading as 1990 retro, 295 Madison Avenue, FL 12 #1004, New York, NY 10017, United States, support@1990retro.com, +1 855-817-3876.

Part A applies to products delivered to the United States and to countries other than those in Part B. Part B applies if you are a consumer resident in the European Union, the European Economic Area or the United Kingdom, and applies to you instead of Part A.

This commercial warranty is in addition to your statutory rights and does not affect them. If you are a consumer in the European Union, the EEA or the United Kingdom, you have a legal guarantee that goods conform to the contract, provided free of charge, for at least two years in the EU and EEA, and the rights given by the Consumer Rights Act 2015 in the United Kingdom. Those rights are set out in Part C of our Terms of Purchase and apply regardless of this warranty.

Part A — Commercial warranty: United States and rest of world

A1. Warranty period

We warrant to the purchaser of our products, in their original packaging, that they are free from defects in materials and workmanship when used and stored normally in accordance with our user instructions, for the following periods:

Yūgen Lanterns: 1 year from delivery.

Accessories: not covered by this commercial warranty.

A2. How to obtain warranty service

This warranty applies to products purchased through this website. If you bought a defective product from a reseller, contact that reseller for its warranty service; if you cannot resolve the matter with them, you may contact our customer service.

Contact support@1990retro.com before returning anything. We may ask you to furnish proof of purchase, to respond to questions designed to assist with diagnosing potential issues, and to follow our procedures for obtaining warranty service. The product must be delivered in either its original packaging or packaging affording an equal degree of protection.

Important: do not attempt to open the product or remove any protective caps attached to the product. Opening the product or removing protective caps may cause damage that is not covered by this limited warranty. Only 1990 retro should perform service on this product.

A3. Extent of warranty

If your warranty claim has been accepted, we will, at our sole discretion, either replace the product that is returned, or refund your purchase price, from which we may deduct a reasonable amount for depreciation. A replacement may be made by a new product at our sole discretion. When a product or part is replaced, or when a refund is provided, any replacement item becomes your property and the replaced or refunded item becomes our property.

A4. Exclusions from warranty

This warranty does not apply to: microSD cards; software; cables; adapters; batteries; wrist straps; keychains; other consumable parts that are designed to diminish over time; and our accessories.

In addition, this warranty does not apply:

to cosmetic damage, including but not limited to scratches or dents, unless failure has occurred due to a defect in materials or workmanship; to damage caused by use with a third-party component or product; to damage caused by accident, abuse, misuse, mishandling, misplacement or alteration; to damage caused by fire, earthquake, electrical power problems, theft or other external cause; to damage caused by operating the product outside our published guidelines or with incompatible accessories or a third-party device; to damage caused by service performed by anyone who is not authorised by us; to a product that has been modified to alter functionality or capability without our written permission; to defects caused by normal wear and tear or otherwise due to the normal aging of the product; to damages or defects due to a failure to follow operating or maintenance instructions, or due to services performed by anyone other than us; if the serial number of the product has been removed or altered; to damage caused as a result of improper transportation or packing when returning the product; and if we receive information from relevant public authorities that the product has been stolen, or if you are unable to present proof of purchase.

A5. Limitation of liability

Our liability under this warranty is strictly limited to repairing or replacing the product. We do not accept liability for indirect or consequential loss of any kind due to a defective product.

A6. Consumer rights

This warranty is in addition to, and does not derogate from, any of your local statutory consumer rights.

Part B — Consumers in the European Union, the EEA and the United Kingdom

This Part applies if you are a consumer, meaning you are acting wholly or mainly outside your trade, business, craft or profession, and you are resident in the European Union, the European Economic Area or the United Kingdom.

B1. The commercial warranty is not offered

The commercial warranty in Part A is not offered for products delivered to the European Union, the EEA or the United Kingdom. Your statutory rights, which are longer in duration and wider in remedy, apply in full and are set out below.

B2. Legal guarantee of conformity

European Union and EEA: we are liable for any lack of conformity that exists at the time of delivery and becomes apparent within two years of delivery. You are entitled to have the goods brought into conformity by repair or replacement, and to a proportionate price reduction or termination of the contract where repair or replacement is impossible, disproportionate, or not completed within a reasonable time. A lack of conformity becoming apparent within one year of delivery is presumed to have existed at the time of delivery. This guarantee is provided free of charge.

United Kingdom: under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose and as described. You may reject faulty goods within 30 days of delivery for a full refund, and are entitled to repair or replacement thereafter.

B3. Making a claim

Contact support@1990retro.com with your order number. Photographic evidence assists assessment but is not a condition of any claim, and no reporting deadline applies other than the periods in B2. We bear the cost of returning goods that are not in conformity. No deduction for depreciation is made where you exercise your statutory remedies.

B4. Liability

Nothing in this document excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, for the legal guarantee in B2, or for any liability that cannot be excluded or limited under the law applicable to you.

B5. Complaints and dispute resolution

Information on out-of-court dispute resolution for your country is set out in our Legal notice.

B6. Consumables, wear and durability

Conformity is assessed against what is normal for goods of the same type. Normal wear and tear, the gradual depletion of batteries and the consumption of parts designed to diminish with use are not a lack of conformity. Consumable items and accessories are nonetheless covered by the legal guarantee in B2 where they do not conform to the contract at the time of delivery.

B7. Items excluded from return

Where the right of withdrawal does not apply to an item, for example sealed goods unsuitable for return on health or hygiene grounds once unsealed, that exclusion concerns withdrawal only. Your rights under the legal guarantee in B2 apply to those items in full.

B8. Goods with digital elements

Where a product contains digital content or a digital service, the legal guarantee in B2 extends to those digital elements. We will supply updates, including security updates, necessary to keep the product in conformity, and will inform you of them, for the period you may reasonably expect given the type and purpose of the product and in any event for the duration of the guarantee period. Where the digital content is supplied continuously over a period longer than two years, we are liable for any lack of conformity occurring during that period.

Governing law

This warranty forms part of the contractual arrangements set out in our Terms of Purchase and is governed by the law stated there. If you are a consumer resident in the European Union, the EEA or the United Kingdom, you retain the protection of the mandatory consumer law of your country of residence.
