Terms of Purchase

Scope and precedence
These Terms of Purchase govern the purchase of products from our website. Your use of the website is governed separately by our Terms of Service; where those conflict with these Terms of Purchase in relation to a purchase, these Terms of Purchase prevail.
Part A applies to every order. Part B applies to orders delivered to the United States and to countries other than those in Part C. Part C applies where you are a consumer resident in the European Union, the European Economic Area or the United Kingdom, and prevails over Parts A and B to the extent of any inconsistency.
Part A — Terms applying to every order
A1. Who you are buying from
ANNAPOM SOLUTIONS LLC, trading as 1990 retro, a New York domestic limited liability company registered with the United States Department of State under DOS ID 7414198, business address 295 Madison Avenue, FL 12 #1004, New York, NY 10017, United States.

A2. Placing an order
Before ordering you provide certain details, including your email address and delivery address. When you place your order we send you an email confirming receipt of the order and setting out its details. That email acknowledges your order; it does not accept it.
We accept your order when we send you a shipping confirmation email, at which point the contract is concluded. We usually send that email within five (5) days of receiving your order.
If you cancel before we have accepted your order, we promptly refund any payment already made.
A3. Refusing or changing an order
We may refuse any order. We may limit or cancel quantities purchased per person, per household or per order, including orders placed under the same customer account, the same payment card, or using the same billing or delivery address. If we change or cancel your order, we will notify you.
A4. Who we sell to
We sell to end customers for private use. Purchasing through our website for resale or commercial export is not permitted, and we may limit or prohibit orders that in our judgment are placed for resale or export.
We do not sell to minors. If you are under 18 you may order only with the permission of a parent or legal representative.
A5. Availability
Where we know a product is unavailable we say so on its page. If a product proves unavailable after you order, we will tell you by email as soon as possible, you will not be charged for it, and any payment already taken for it will be refunded.
A6. Your account information
You agree to provide current, complete and accurate purchase and account information, and to update it promptly, including your email address and payment card details, so that we can complete your transactions and contact you.
A7. Prices, payment and invoices
The price of a product is the price displayed when you place your order. We may change prices at any time, but a price change never applies to an order already placed.
Taxes and shipping costs are shown at checkout and vary by destination and carrier. All payments are made in the currency shown on the website, without deduction. If your account is held in another currency, any conversion cost is yours.
Payment is processed by our payment service provider through its secure service, which meets applicable security standards. 1990 retro does not have access to your full payment card data.
You consent to receive invoices electronically by email.
A8. Delivery and carriers
Goods are dispatched from China. Delivery destinations, carriers and estimated delivery times are set out in our Shipping Policy.
Delivery is made by a carrier of our choice; we may offer a choice of carriers or shipping methods. Unless stated otherwise you bear the shipping costs, which depend on weight, shipping method and delivery address. We use traceable services.
You receive a shipping confirmation email with a tracking number when your order is dispatched, and can also check status in your account.
A9. Title
Products remain our property until they have been paid for in full. Until title passes, the products must be handled with due care.
A10. Promotions
We run promotions from time to time for limited periods, on the terms stated on the website. Promotional discounts cannot be combined with other discounts. We may exclude particular items. Where we advertise a price reduction, the previous price shown is the lowest price we charged in the 30 days before the reduction, and the exact price difference is reflected in the "from" and "to" prices. Stock is allocated first come, first served. Returned items are refunded at the discounted price actually paid. We may end a promotion at any time, which never affects an order already placed. All other terms apply during promotions.
A11. Product information
Product descriptions, images, colours and measurements are provided as accurately as we can. Screen rendering of colour varies between devices. Always read the labels, warnings and instructions supplied with a product before use.
A12. Electronic communication
You consent to receive communications from us electronically, and agree that notices, disclosures and confirmations sent by email satisfy any requirement that they be in writing.
A13. Events outside our control
We are not responsible for delay or failure to perform caused by circumstances beyond our reasonable control, including strikes, terrorist acts, war, supplier or transport failure, governmental or regulatory action and natural disasters. We will perform as soon as reasonably possible.
A14. Privacy
Personal data is processed in accordance with our Privacy Policy.
A15. Waiver and severability
A failure or delay in exercising a right or remedy is not a waiver of it, and a partial exercise does not prevent further exercise. Our rights and remedies are cumulative and additional to those provided by law. If any provision is found unlawful, void or unenforceable, it is severed and the remaining provisions continue in force.
A16. Changes to these terms
We may update these Terms of Purchase. The version applying to your order is the version published when you placed it.
Part B — United States and rest of world
B1. Import
You are the importer of record and must comply with the laws and regulations of the country in which you receive the products, including ensuring that they may lawfully be imported, and paying any import duties and handling fees. An exception applies to deliveries to the United States, where 1990 retro acts as importer of record and manages import compliance, duties and related fees.
B2. Risk
Risk in the products passes to you on delivery to you or to a third party indicated by you.
B3. Damage during shipment
If your shipment arrives damaged, do not accept the shipment and have the courier confirm the damage at that time. Courier services do not accept damage complaints filed later, and we are not able to offer compensation or replacement in such cases.
B4. Returns
We operate a 30-day return policy. If you are not satisfied, you may return a product for a full refund within 30 days of receiving it, provided it is in the same condition as received, unused and unopened, with all original packaging and documentation.
Contact support@1990retro.com with your order ID. All returns must be authorised by our support team, which will issue an RMA number and the return address. Returns without a valid RMA number may not be processed and may delay any replacement or refund.
You are responsible for the shipping costs of your return and bear the risk of loss in transit. Consider a trackable service or shipping insurance; we do not guarantee that we will receive your returned item.
Once your return is received and inspected, we email you to confirm receipt and to notify you of the approval or rejection of your refund. Approved refunds cover the full purchase price of the returned products including our initial shipping charge.
B5. Defective products
Clause B4 applies principally to unwanted products. If you believe a product is defective, contact us and your claim will be evaluated under our Warranty Policy. Where the product was bought from an authorised reseller, contact that reseller for warranty service; if you cannot resolve the matter with them, you may contact our support team.
B6. Limitation of liability
Use of our products is at your sole risk. We are not liable for indirect, incidental, consequential, punitive or exemplary damages, or for loss of income, profits, bargain, revenue, contracts or goodwill; for inability to order products through our website; or for damage arising from unauthorised third-party access to your order account.
B7. Governing law and jurisdiction
These Terms of Purchase and any dispute arising from them are governed by the laws of the State of New York, United States, and you submit to the exclusive jurisdiction of the courts of New York.
Part C — Consumers in the European Union, the EEA and the United Kingdom
This Part applies if you are a consumer, meaning you are acting wholly or mainly outside your trade, business, craft or profession, and you are resident in the European Union, the European Economic Area or the United Kingdom. It prevails over Parts A and B to the extent of any inconsistency.
C1. Language, conclusion and storage of the contract
The contract is concluded in the language of the version of this website and checkout in which you placed your order. Where these terms are available in more than one language, the version in the language in which you concluded the contract governs. Before placing an order you select the products, add them to your cart, enter your delivery and payment details and review a summary of your order; you may correct input errors at any point before confirming the order. We store the terms of your order and send them to you by email together with these terms.
C2. Prices, VAT and import charges
Prices shown to you include VAT at the rate of your delivery country. Delivery costs are shown separately before you pay, and the total payable is shown at checkout.
Your order is dispatched from outside the European Union and the United Kingdom, so VAT is payable on import. Depending on destination and value, that VAT is either charged by us at checkout or collected at the border on delivery. Which applies to your order is shown at checkout before you pay.
European Union and EEA: where we are registered for the EU Import One-Stop Shop, VAT on consignments with a goods value of EUR 150 or less is charged at checkout and paid by us on import, and nothing further is payable on delivery. Where we are not so registered, or the goods value exceeds EUR 150, import VAT and any customs duty are collected at the border and payable by you, together with any carrier handling fee.
United Kingdom: for consignments with a goods value of GBP 135 or less, UK VAT is charged at checkout and accounted for by us. Above that value, import VAT and any customs duty are collected at the border and payable by you, together with any carrier handling fee.
C3. Delivery period
We deliver without undue delay and in any event within 30 days of the conclusion of the contract, unless we agree another date with you. If we fail to deliver within that period you may give us an additional reasonable period; if we fail to deliver within that period as well, you may terminate the contract and we will refund all sums paid without undue delay.
C4. Risk of loss and damage
Risk passes to you only when you, or a third party named by you who is not the carrier, take physical possession of the goods. Clauses B2 and B3 do not apply to you. If your order does not arrive, or arrives damaged, contact support@1990retro.com; we will replace it or refund you, and you are not required to refuse delivery or to claim against the carrier.
C5. Your right to withdraw within 14 days
You may withdraw from this contract within 14 days without giving any reason. The period ends 14 days after the day on which you, or a third party named by you who is not the carrier, take physical possession of the goods; where the order is delivered in several consignments, 14 days after receipt of the last consignment.
To exercise the right, inform us by an unambiguous statement before the period ends, by email to support@1990retro.com or by post to ANNAPOM SOLUTIONS LLC d/b/a 1990 retro, 295 Madison Avenue, FL 12 #1004, New York, NY 10017, United States. You may use the model withdrawal form in C7, but you are not required to, and no RMA number is required. Dispatching your notification before the period expires is sufficient to meet the deadline.
C6. Effects of withdrawal
We reimburse all payments received from you, including the costs of delivery, except supplementary costs arising from your choice of a delivery method other than the least expensive standard delivery we offer, without undue delay and within 14 days of the day on which we are informed of your decision. Reimbursement is made using the same means of payment you used for the initial transaction, at no cost to you. We may withhold reimbursement until we have received the goods back, or until you have supplied evidence of having sent them back, whichever is earlier.
You must send the goods back without undue delay and within 14 days of notifying us. The deadline is met if you dispatch them before that period expires. You bear the direct cost of returning the goods. The amount depends on the carrier and service you choose. You may inspect and handle the goods as you would in a shop, and are liable only for any diminished value resulting from handling beyond that.
The right of withdrawal does not apply to goods made to your specification or clearly personalised, to sealed goods unsuitable for return for health protection or hygiene reasons once unsealed, or to sealed audio or video recordings or computer software once unsealed.
C7. Model withdrawal form
Complete and return this form only if you wish to withdraw from the contract.

C8. Legal guarantee
European Union and EEA: we are liable for any lack of conformity existing at delivery that becomes apparent within two years. You are entitled to repair or replacement, and to a proportionate price reduction or termination of the contract where repair or replacement is impossible, disproportionate or not completed within a reasonable time. A lack of conformity becoming apparent within one year of delivery is presumed to have existed at delivery.
United Kingdom: under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose and as described. You may reject faulty goods within 30 days of delivery for a full refund, and are entitled to repair or replacement thereafter.
We bear the cost of returning goods that are not in conformity. Any commercial guarantee, including our Warranty Policy, is additional to these rights and does not replace or limit them. Clause B5 does not apply to you.
C9. Voluntary returns
In addition to C5, we accept returns of unwanted items within 30 days of delivery where the item is unused and in its original packaging with documentation, on the terms in our Refund Policy. This is a voluntary commercial policy and does not affect your statutory rights.
C10. Complaints and dispute resolution
Complaints may be sent to support@1990retro.com with your order number. We acknowledge complaints within two business days. Information on out-of-court dispute resolution for your country is set out in our Legal notice.
C11. Liability
Clause B6 does not apply to you to the extent that it excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, for the legal guarantee in C8, or for any liability that cannot be excluded or limited under the law applicable to you.
C12. Governing law and jurisdiction
These Terms of Purchase are governed by the law of the State of New York. As a consumer you retain the protection of the mandatory consumer law of your country of residence, and nothing in these terms removes it. Clause B7 does not apply to you: you may bring proceedings in the courts of your country of residence, and we will bring any proceedings against you there.
C13. Changes
Changes to these Terms of Purchase never apply to an order already placed.
